Federal preemption and its impact on state restrictions limiting access to mifepristone and abortion care
December 5 @ 8:00 pm–9:00 pm EST
Session Overview
The FDA’s Risk Evaluation and Mitigation Strategy (REMS) for mifepristone allows patients to obtain the drug without an in-person visit to a clinician. Ongoing federal litigation has challenged the FDA’s REMS for mifepristone, seeking to add or remove restrictions. In the meantime, mifepristone access is being undermined by additional restrictions at the state level, imposed by state law. Doctors and lawyers are now working together to challenge these state restrictions and ensure that the FDA, not state legislatures, makes the rules for access to mifepristone. This session will explore the role of the law of federal preemption, its impact on practicing medicine, and how clinicians can get involved.
Key Takeaways
- Educate physicians on current state legislation restricting use of mifepristone that directly conflicts with FDA REMS.
- Explain the role of federal preemption and how upholding current, restrictive state laws could have a broader impact on:
- access to other drugs, ex. HIV PrEP and opioids;
- inflict widespread harms on the medical profession;
- inflict widespread harms on patients.
- Encourage physicians to engage on these issues; highlight the case of Bryant vs. Stein and the need to support this challenge.
